Public Agreement

This document constitutes an official offer by KUKI Agency, LLC (hereinafter referred to as the “Contractor”) to enter into an agreement for the provision of services for consideration and access to digital content (hereinafter referred to as the “Offer”) with any natural person, sole proprietor, legal entity (represented by its employees and other authorized representatives) who uses the Almost read platform and has completed the registration process as a User of the platform, hereinafter referred to as the Buyer, under the terms and conditions set forth below.

The publication of this Offer on the website almostread.com constitutes a public offer in accordance with paragraph 2 of Article 407 of the Civil Code of the Republic of Belarus.

Payment for services via the WebPay payment service or the purchase of a subscription through the Apple App Store constitutes acceptance of this Offer (Article 408 of the Civil Code of the Republic of Belarus).

1.1. The Contractor provides the Buyer with access to the paid features of the Almost read platform, including, but not limited to:
• advanced reading statistics;
• access to private sections and clubs;
• additional journal features;
• access to digital content posted by the Contractor;
• other paid services specified in the Almost read mobile app

1.2. The services are provided in digital form and have no physical medium.

1.3. The specific list of paid features, terms, and cost are specified in the Almost read mobile app.

2.1. Payment via the WebPay payment service
2.1.1. When paying via the WebPay payment service, settlements are made directly between the Buyer and the Service Provider.
2.1.2. The cost of services is specified in the Almost read mobile app.
2.1.3. Payment is considered complete upon confirmation of a successful transaction by the WebPay payment service.

2.2. Payment via the Apple App Store.
2.2.1. Purchases of subscriptions or other paid features through the Apple App Store are made in accordance with Apple’s terms and conditions.
2.2.2. Payments for such purchases are processed by Apple Distribution International Ltd. The Provider does not participate in the payment processing.
2.2.3. The cost of services is determined by Apple and may differ from the cost when paying via the WebPay payment system.

3.1. Access to paid features is granted automatically upon successful payment.

3.2. The duration of access is determined by the terms of the specific service (one-time access, subscription, access period, etc.).

3.3. The purchaser is responsible for ensuring the accuracy of their account information.

4.1. When paying via the WebPay payment service, acceptance is evidenced by the successful payment for the services.

4.2. When paying via the Apple App Store, acceptance is evidenced by the purchase confirmation in the App Store.

4.3. Acceptance implies the Buyer’s full agreement with:
• this Offer;
• the User Agreement;
• the Privacy Policy;
• the Terms of Use for the Almost read platform.

5.1. Refunds for payments made via the WebPay payment service are possible only if a technical error occurred during the payment process. If a digital product was paid for with a credit card, the refund will be issued to the same card used for the original payment. In the event of a refund, the funds will be returned to the customer’s card within 30 days, depending on the card-issuing bank.

5.2. Refunds for payments made through the Apple App Store are handled exclusively by Apple.
5.2.2. The Provider does not have the technical capability to issue refunds for purchases made through the App Store.
5.2.3. The Buyer may request a refund through Apple’s service: reportaproblem.apple.com

6.1. The Provider agrees to:
• provide access to paid features after payment;
• ensure the platform’s operability within the limits of its technical capabilities;
• handle inquiries from Buyers.

6.2. The Contractor has the right to:
• change the cost of services;
• update the platform’s functionality;
• temporarily restrict access for technical maintenance;
• block access in the event of a violation of the User Agreement.

6.3. The Buyer agrees to:
• comply with the terms of the User Agreement and the Privacy Policy;
• not to transfer access to third parties;
• to respect copyrights.

7.1. The Contractor shall be liable only for direct damages caused by its own fault.

7.2. The Contractor shall not be liable for:
• the actions of third parties;
• malfunctions of the Buyer’s equipment;
• inability to access the platform for reasons beyond the Contractor’s control;
• data loss caused by the Buyer’s violation of the platform’s terms of use.

8.1. The relationship between the Contractor and the Buyer shall be governed by the laws of the Republic of Belarus.

8.2. All disputes, disagreements, or claims arising from this Offer shall be resolved through negotiations between the Parties.

8.3. If a dispute cannot be resolved through negotiations, it shall be brought before a court at the Contractor’s place of business in accordance with the laws of the Republic of Belarus.

8.4. For Buyers who have made a payment through the Apple App Store:
• payments and refunds are governed by Apple’s rules;
• however, any disputes related to the use of the Almost read platform, its functionality, content, and the Contractor’s obligations shall be resolved in accordance with this Offer and the laws of the Republic of Belarus.

8.5. The Buyer agrees that the Apple App Store rules govern only the procedures for payment, refunds, and subscriptions, but do not replace or supersede the provisions of this Offer.

9.1. This Offer remains in effect indefinitely until revoked by the Contractor.

9.2. The Contractor has the right to amend the terms of this Offer by publishing a new version on the website almostread.com.

9.3. The new version takes effect upon publication.
